TERMS OF SERVICE

Welcome to the Move The Crowd family! (MTC) This customized coaching program is designed to engage the most promising entrepreneurs in a rigorous experience to develop, execute, and achieve significant personal business development and growth goals.

I. Payment:

The Standard Payment Schedule for Coaching Services is Pay In Full. Payment for all Coaching Services is to be paid as indicated on your Program Order Form. Move the Crowd, LLC may in its sole discretion offer you an Installment Plan whereby you may pay for the Coaching Services in the designated number of Autopay installments.

If you choose to pay by Autopay installments, you must provide Move the Crowd, LLC with a current, valid credit or debit card or bank account information as a form of payment as such may be updated from time to time and complete the AutoPay Authorization process required by Move the Crowd, LLC. If you have been approved for an Installment Plan, all Autopay installment payments are due on the same day each month, on the date that you start the Installment Plan. On your recurring billing date, Move the Crowd, LLC will deduct the applicable monthly payment from the form of payment that you have provided. Please note that ANY Installment Plan will have an 8% Processing Fee added to each installment. If payments are past due, Move the Crowd, LLC reserves the right to suspend all services to you. In addition, you will be charged $30/hr for any administrative time spent updating a delinquent program.

Should a payment be declined you agree to pay a $50 NSF (insufficient funds) fee in addition to any administrative and bank fees that MTC incurs for any returned checks, chargebacks, declined charges, and late fees and provide MTC with an alternative form of payment.  It is your responsibility to ensure that your payment information is up to date. If for any reason your payment information changes, please contact us at [email protected].  Please note, if you select the Autopay installment option you are still responsible for the full price of the course, and your designated method of payment will be charged automatically each month on the same day for the monthly installment amount.

II. Coaching/coachee Relationship:

The Coachee agrees to put forth the best effort possible throughout the coaching process and remain open to the principles and methodologies introduced therein.

This includes but is not limited to:

1. Being on time for all scheduled appointment(s).
2. Doing the homework as assigned.
3. Being prepared to take notes and experience activities.
4. Being “coachable” - i.e. bringing an open mind and heart to the process.
5. Working during the coaching session and in between sessions to achieve the desired goals.
6. Respecting the confidentiality and proprietary nature of the principles, methodologies, and assignments shared within.
7. Being in communication around any breakdowns, issues, concerns, or problems that impact The Coachee’s ability to fulfill any or all of the above. 

The Coach agrees to maintain the highest standards of integrity and encourage the most beneficial application of the principles and methodologies offered herein to produce the best results.

This includes but is not limited to:

1. Being on time for a scheduled appointment(s).
2. Being fully “present” i.e. giving the Coachee their 100% undivided attention.
3. Bringing to bear the best resources, experience, and counsel available.
4. Creating an open and encouraging space for authentic dialogue.
5. Holding the Coachee accountable for achieving articulated goals.
6. Holding all personal and business information shared by Coachee in strict confidence unless otherwise directed by Coachee.

If the Coachee is participating in a group program, the additional guidelines apply:  

1. Coachee agrees to help create an open and welcoming environment by engaging with Coach and other program participants in a respectful and professional manner at all times.
2. Coachee agrees to keep all of the information shared by other participants confidential this includes but is not limited to any business ideas, intellectual property, materials, personal stories, or information.
3. Coachee agrees to encourage other members through their own participation and through their undivided attention when the Coach or other group members are sharing. 
4. Coachee agrees to put forth their best effort in all aspects of the program including engaging with the private community and program buddy structures (if applicable).
5. Coachee agrees to refrain from any form of promotion and/or solicitation of other members of the group outside of the specific guidelines set by the Coach. This includes a 100% solicitation free environment - if stipulated by the Coach. 

III. Cancellation:

Should you cancel services, please be advised that your payment(s) are non-refundable. However, you may be able to apply your remaining credits or installments towards a different program if used within (6) months of cancellation.  In this regard, if you have selected the monthly Autopay installment payment, MTC will continue to deduct your Autopay installment payments until the amount indicated on the Program Order Form is paid in full. You have the option to prepay any outstanding amount in full at any time.

IV. Intellectual Property:

MTC owns or licenses all rights, title, and interest in and to the material presented and used in its digital and online courses, programs, and events (collectively, “Products”) and all intellectual property rights therein are the proprietary interest of MTC and shall remain exclusively with MTC. You promise that any notes that you take or record will be for your personal and professional use only. You will not resell, license, disseminate, broadcast, create a derivative work, or otherwise distribute any of the materials presented and used in the Products without the prior written consent of MTC. Furthermore, you will not coach or attempt to coach other individuals by using the principles and methodologies employed in the Products without the prior written consent of MTC. Copying, duplicating, or otherwise reproducing assets from the Products outside of your participation and the associated learning is prohibited.

V. Earnings Disclaimer:

MTC seeks to engage highly motivated people who aspire to achieve through hard work and dedication. We’ve worked diligently to ensure that the promises of all of our content, products, and programs accurately reflect their ability to support your efforts to achieve your desired goals that are consistent with the program. However, MTC does not and legally cannot guarantee that you will get any results or earn any money using our tools, methodologies, strategies, or recommendations and nothing on our Sites or in our product materials or otherwise is a promise or guarantee of future earnings.

VI. You Expressly Agree to use this Program Solely at Your Own Risk:

By purchasing the Coaching Program, you agree to take full responsibility for your results or lack thereof.  As with any business, your results may vary and will be based on your individual capacity, business experience, expertise, relationship capital, and level of desire. We make no representations, warranties, or guarantees verbally or in writing regarding your earnings, venture profit, marketing results, increase in audience, or any other results. The testimonials and examples used are exceptional results and are not intended to represent or guarantee that anyone will achieve the same or similar results. Each individual’s success depends on his or her background, dedication, desire, and motivation. We offer no professional legal, medical, psychological, or financial advice.

VII. Miscellaneous:

1. These terms and conditions shall be deemed to have been made in the State of New Jersey and any and all performance hereunder, or breach thereof, shall be interpreted and applied in the State of New Jersey. The parties hereto hereby consent to personal jurisdiction and venue exclusively in the State of New Jersey with respect to any action or proceeding brought with respect to these terms and conditions.
2. These terms and conditions contain all oral and written agreements, representations, and arrangements between the parties with respect to its subject matter, and no representations or warranties are made or implied, except as specifically set forth herein.  
3. MTC reserves the right to terminate your participation in the Coaching Program if you engage violate any of these terms and conditions or act in a manner that is detrimental or disruptive to MTC and/or the other participants.
4. MTC reserves the right to amend these terms and conditions from time to time by posting such changes on its website.
